    By using the Website, you confirm that you have read and accept these Terms. If you do not agree to the Terms, please do not use the Website.

    Unless otherwise stated, all Website materials (texts, images, logos, interfaces, design, software code, and other elements) are the intellectual property of Gazer or are used lawfully.
    You may view and use the Website only for personal and lawful purposes.
    You must not:
    • copy, modify, distribute, publish, or otherwise use the Website materials without the prior written consent of the rights holder, except where expressly permitted by law;
    • take actions aimed at disrupting the operation of the Website or gaining unauthorized access to systems.
  • 3. Registration and account (if applicable)
    When registering on the Website, you agree to provide accurate information and keep it up to date. You are responsible for safeguarding your login credentials and for all actions performed under your account.
  • 4. Links to third-party resources
    The Website may contain links to third-party websites or services. We do not control such resources and are not responsible for their content, availability, or data processing practices.
  • 5. Disclaimer of warranties
    The Website is provided "as is" and "as available". We do not guarantee uninterrupted operation, error-free functionality, or that the Website will meet your expectations.

• Part B — Mobile App Terms of Use (Gazer CAR Android/iOS)

  • 8. General provisions
    These provisions apply to the Gazer CAR mobile application (Android/iOS) and the related Service.
    By using the App, you confirm that you accept these Terms and agree with the Privacy Policy (available on gazer.com in the Privacy Policy section).
  • 9. License to use the App
    We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal lawful use to manage functions and display information related to your vehicle and/or telematics device.
    You must not:
    • modify, decompile, disassemble, or attempt to derive the source code of the App, except where expressly permitted by law;
    • bypass security measures, interfere with the operation of the App/Service, or use them for unlawful purposes;
    • use the App to access vehicles/accounts you are not authorized to use.
  • 10. Account, security, and access
    An account is required to use the Service. Authentication may include a phone number, password, and PIN.
    You agree to:
    • keep your access credentials (password, PIN) confidential;
    • not share access with third parties;
    • notify us immediately if you suspect unauthorized access.
    You are responsible for actions performed through your account.
  • 11. Functionality, permissions, and location
    Some App features require an internet connection and device permissions.
    The phone's location may be requested and used only when using map features (for example, when you tap "Show on map") to display your position on the map. If you disable location access, map features related to showing your position may have limited functionality.
  • 12. Messages and notifications (SMS and push)
    The App/Service may send:
    • push notifications (via Firebase Cloud Messaging), and
    • SMS messages (via Twilio and AWS).
    Your mobile operator may charge fees for SMS/data. For SMS delivery, a third-party provider may process message content and delivery data.
  • 13. Vehicle and Service data
    The Service may display data received from the device installed in the vehicle, including vehicle location, trip history, telemetry, and events. The accuracy and timeliness of the data may depend on network quality, settings, the condition of the in-vehicle device, and other factors.
  • 14. Safety and usage warning
    Do not use the App in a way that distracts you while driving. The user is responsible for complying with traffic laws and safety requirements.
    The App and Service are supporting tools and cannot guarantee the prevention of theft, damage, or other incidents.
  • 15. Updates and changes
    We may release App updates and change the Service functionality, including adding, changing, or discontinuing certain features for security reasons, technical reasons, improvements, or legal requirements.
  • 16. Suspension and termination of access
    We may suspend or terminate access to the Service (including blocking an account) if:
    • these Terms are violated,
    • there are signs of abuse or security threats,
    • this is required by law or competent authorities.
    You may stop using the App at any time and delete your account as described in the Privacy Policy.
  • 17. Disclaimer of warranties
    The App and Service are provided "as is" and "as available". We do not guarantee that the App/Service will operate without errors or interruptions or that they will meet your expectations.
  • 18. Limitation of liability
    To the extent permitted by law, Gazer is not liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or reputation, arising out of or related to the use of, or inability to use, the App/Service.
  • 19. Governing law
    These Terms are governed by applicable law of Ukraine. If applicable law requires otherwise, the relevant provisions apply to the extent required by law.
